CANON EUROPA N.V. CANON EOS RP - REWARD OFFER TERMS AND CONDITIONS
1. THE PROMOTER
The promoter is Canon Europa N.V., registered at Bovenkerkerweg 59, 1185 XB, Amstelveen, the Netherlands ("Canon").
2. ABOUT THE OFFER
2.1. Participants
2.1.1 All Participants must be aged 18 or over and must be a resident in the EEA or Andorra or Monaco or Switzerland. ("Participant").
2.1.2 All Participants are deemed to have agreed to be bound by these Terms and Conditions.
2.1.3 Distributors and retailers are excluded from the promotion and shall not be eligible to participate on behalf of their customers.
2.2. Offer Products, Territory and Periods
2.2.1 The offer can be redeemed from 00.00 on February 27th, 2019 and midnight on June 30th, 2019 ("Offer Period").
2.2.2 This offer is only available on purchases made of any of the products listed in clause 3 (“The Offer Products”) from retailers located within; Andorra, Austria, Belgium, Czech Republic, Denmark, The Netherlands, France, Finland, Hungary, Germany, Italy, Norway, Poland, Portugal, Slovakia, Spain, Sweden, Switzerland, Lichtenstein, Estonia, Latvia, Lithuania, Luxemburg and Monaco or from an Internet store with a domain or a registered address in any of the countries listed above (the "Offer Program Territory").
2.2.3 All Offer Products must be new and genuine Canon products. Purchases of second hand, refurbished or reconditioned products, or products which are counterfeit or infringe the intellectual property rights of the Canon group companies in any way (for example including but not limited to parallel or "grey" products) will not qualify under this Offer. 2.2.4 All the Offer Products must have been supplied to the EEA plus Switzerland or Andorra or Monaco and distributed by Canon Europa N.V. or Canon group companies located in the EEA, Switzerland or Andorra or Monaco. Please always check with your retailer to avoid disappointments.
2.2.5 Offer Products returned (free of default) to the seller shall not be valid for the promotion and Participants found claiming for these products shall not be eligible. If Canon becomes aware of any such fraud, it shall be free to take a legal action against any Participants involved.
3. How to Participate
3.1.1 To participate in the offer the Participant must purchase a CANON EOS RP body or CANON EOS RP kit AND a lens included in the CANON EOS RP promotion AND make a valid claim online. The claim must be made within the offer period.
3.1.2 Lenses included in the CANON EOS RP promotion; EF 24-105mm f/3.5-5.6 IS STM, RF 35mm F1.8 MACRO IS STM, EF 70-300mm f/4-5.6 IS II USM, EF 24-70mm f/4L IS USM, EF 70-200mm f/4L IS II USM, EF 16-35mm f/4L IS USM, RF 24-105mm F4L IS USM.
3.2 To make a Claim, please complete the following:
(i) Correctly complete and submit an online claim form (including specifying valid product serial number(s).
(ii) Scan, upload and attach to the online claim form a copy of your till receipt for both products, or order confirmation for internet purchases (including VAT).
(iii) Participants will then receive an email confirming that their claim has been received along will log in details to a portal in which they can check the status of their claim. If you do not receive a confirmation email within 24 hours of processing your claim, or do not have access to a computer, please contact our Claim Hotline on +353 16 990 990.
3.3 The Offer Products are subject to availability while stocks last. Canon will not be liable for the failure of retailers to fulfil orders of Promotional Products during the Promotional Period.
3.4 Only one claim per Promotional Product purchased may be made.
3.5 This promotion cannot be redeemed in conjunction with any other promotion.
3.6 Upon receipt and verification of the claim Participants will receive Cashback in the amounts shown for purchases of the Offer Products. No alternative arrangement will be entered into and no cash or cheque will be provided.
3.7 Canon will endeavour to transfer via BACS within 28 days of receipt of a complete and valid claim.
3.8 Where a Participant fails to select one of the currencies offered in the claim form, one may be allocated at Canon’s absolute discretion.
3.9 Canon will not process any claims received after the closing date for receipt of claims of 28th September 2019. Canon will not process claims which are in its opinion incomplete or illegible. Canon will not be responsible for claims delayed or not successfully received.
3.10 Only one BACS payment will be issued per valid claim.
3.11 If you are VAT registered and you receive a rebate, it may reduce the taxable value of your purchase and so you may need to reduce your input tax accordingly.
4. DISCLAIMERS
4.1. To the fullest extent permitted by law, Canon shall not be liable for any loss, damage or injury of any nature howsoever caused, sustained by any Participant under this promotion. However, nothing in these rules shall have the effect of excluding or restricting Canon’s liability for personal injury or death caused by the proven negligence of Canon’s employees or agents.
4.2. In exceptional circumstances, Canon may void, amend, and/or change other promotional conditions without incurring any liability whatsoever provided that such changes are necessary and can be justified by objective reasons.
4.3. Canon reserves the right to audit any claims to ensure compliance with these terms and conditions and to request additional information and supporting documents. Canon reserves the right to exclude claims and/or Participants if it suspects that the promotion is being abused in any way. Canon’s decisions in relation to the promotion are final and no correspondence will be entered into.
4.4 If any part of these conditions is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable, then such part shall be severed from the remainder of these conditions, which shall continue to be valid to the fullest extent permitted by law.
5. DATA PRIVACY
Canon Europa N.V., 59 Bovenkerkerweg, 1185 XB, The Netherlands, is the Data Controller in respect of any personal data supplied by Participants. The personal data provided is held securely and may be transferred on a secure server outside the EEA. The personal data collected from Participants is subject to the Canon Consumer Data Privacy Policy.
6. LAW AND JURISDICTION
As you are a participating consumer, the Laws of your country of residence will apply to our promotions, and you may be entitled to bring court proceedings in your own language and in your local courts. A local consumer advice organization will be able to advise you of your rights. These Terms and Conditions do not restrict any statutory rights that may be applicable.
